Grand Prize: LEGO 75397 Star Wars: UCS Jabba's Sail Barge. In the event the aforementioned prize is not available when the draw concludes, the LEGO 75367 Star Wars: UCS Venator will be provided instead.

Close Dates and Draw Dates for the Prize

Method of Entry

An eligible entrant must be subscribed to the Promoters subscription service via the Website and accept the Promoters Trade Promotion Terms and Conditions.

Maximum number of entries

An eligible entrant will receive one entry.

Notification of Winner

Winners will be notified via Email and Phone no later than 11th October, 2024.

​

Prize Claim Date

Prize must be claimed by 31st October 2024 or the Prize will be forfeited.

Public announcement of winners

The winners of all prizes will be published on https://www.bricknews.co/ for a minimum period of 28 days from the Draw Date.

Unclaimed Prize Draw

A random unclaimed prize draw will occur by 11th November, 2024.

Draw will take place in the city of Cairns, QLD, Australia.

Notification of unclaimed prize winners

Unclaimed prize winners will be notified via Email and Phone no later than 1st November, 2024.

Public announcement of winners from unclaimed prize draw

The winners of the unclaimed prize will be published on https://www.bricknews.co/ for a minimum period of 28 days from the Unclaimed Prize Draw Date.

  1. Schedule 1 is to be read in conjunction with and forms part of these Terms and Conditions. Participation in this Promotion constitutes acceptance of these Terms and Conditions (and Schedule).

 

  1. Any capitalised terms used in these Terms and Conditions have the meaning given in Schedule 1, unless stated otherwise.

 

  1. The resolution of any discrepancy between these Terms and Conditions and/or Schedule 1 and/or the advertising of the Promotion will be undertaken by the Promoter in its absolute discretion.

 

  1. All decisions and actions of the Promoter relating to the Promotion or redemption of the Prize are exercised at the Promoter's absolute discretion and are final. No discussions or correspondence with entrants or any other person will be entered into.

Eligibility

  1. Entrants are limited to persons registered as a subscriber to the specific membership database managed and owned by the Promoter.

 

  1. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

  1. Entrants must be an existing active subscriber of the Promoter within the Promotion Period and accept these Terms and Conditions.

 

  1. Entry to the Promotion is open to Australian residents who reside in any of the Relevant States and is aged eighteen (18) years or over.

 

  1. All entries of Entrants who are under the age of eighteen (18) years and who enter the Promotion without disclosing or by attempting to conceal their age will be deemed invalid.

 

  1. The Promoter will not advise an Entrant if their entry is deemed invalid.

 

  1. Notwithstanding Clause 8 of these Terms and Conditions, a State or Territory is not considered a Relevant State, if the Total Prize Pool Value for the particular draw exceeds the Maximum Total Prize Pool as follows (unless a permit is held for that state which is noted within Permits of Schedule 1): -

  1. The Entrant must have a residential postal address within Australia or New Zealand. All Entrants who enter the Promotion with a PO Box will be deemed invalid.

 

  1. Employees, immediate family members, retailers, suppliers, associated company’s and agencies related to the Promoter are not eligible to enter in the Promotion.

 

Game of Chance

  1. As the Promotion is a game of chance, and subject otherwise to these Terms and Conditions, skill plays no part in determining the winning Entrant and each valid entry will not be individually judged. Each entry has an equal chance of winning. The winning Entrants will be confirmed by the Promoter.

How to Enter

  1. Entrants must follow the Method of Entry during the Promotion Period to enter the Promotion. 

 

  1. Entrants may only enter the Promotion once.

 

Prize

  1. The Prize/s are specified in the Prize section of Schedule 1.

 

  1. The total prize pool is specified in the Total Prize Value section of Schedule 1.

 

  1. Any Prize is valued in Australian Dollars unless expressly stated otherwise.

 

  1. The Winner will be determined by an electronic random draw system by the Promoter at the Location of Draw in accordance with Schedule 1.

 

  1. Only one (1) Prize per Prize Winner will be awarded.

Claiming prizes

  1. Prizes must be claimed by the Prize Claim Date.

 

  1. If a Prize is not accepted or claimed by the Prize Claim Date, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to conduct an Unclaimed Prize Draw, subject to any directions given by any relevant authority.

 

  1. Winners of unclaimed prizes will be notified and have their names and Postcode of residence published in accordance with Schedule 1.

Non Transferable or Exchangeable

  1. Prizes are not transferable or exchangeable and cannot be taken as cash. The winners accept the prize ‘as is’ and acknowledge that the Promoter accepts no responsibility for any tax implications that may arise from the prize. The winner should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser.

Delivery of Prize

  1. The Promoter will deliver the Prize within twenty-eight (28) days from the date the Entrant was decided by the Promoter.

 

  1. The Promoter will arrange for delivery of the prizes within Australia and New Zealand, after the selection of the winning entries, by mutual agreement with the winner(s).

Social Media

  1. The Promoter may elect to promote the Promotion on third party platforms (including but not limited to YouTube®). Entrants release the third party platform(s) and its/their associated companies from all liability arising in respect of the Promotion and acknowledge that:

    1. the Promotion is in no way sponsored, endorsed or administered by, or associated with, any Social Media Platform;

    2. any information provided by the entrant in connection with the Promotion is provided to the Promoter and not to any Social Media Platform; and

    3. any questions, comments or complaints regarding the Promotion will be directed to the Promoter, not to any Social Media Platform.

Warranties

  1. The Promoter will use its best endeavours to provide the Prize listed. If the Prize is unavailable for whatever reason, the Promoter reserves the right to substitute that prize or item for a prize or item of an equivalent value subject to any written directions given under applicable trade promotion laws and regulations.

 

  1. A prize winner has rights under the Australian Consumer Law and other similar legislation which cannot be excluded, restricted or modified by the Promoter. These rights include a statutory guarantee that any services provided by the Promoter will be rendered with due care and skill and that any goods supplied will be of acceptable quality. These Terms and Conditions do not exclude, restrict or modify those statutory rights in any way. However, to the extent it is permitted by law to do so, the Promoter makes no representations or warranties, express or implied, other than those contained within the Australian Consumer Law, regarding the quality and suitability of any prize and will not be responsible for breach of any such terms.

Liabilities

  1. To the greatest extent permitted by law, the Promoter accepts no responsibility and will not be liable for any late, lost, delayed, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.

 

Dispute Resolution

 

  1. In the event that a dispute arises as to the identity of an online Entrant, the entry will be deemed to have been submitted by the authorised account holder of the email address. The authorised account holder means the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organisation that is responsible for assigning email addresses for the domain associated with the email. The Promoter may ask any Entrant to provide the Promoter with proof that such party is the authorised account holder of the email address associated with the entry.

 

  1. In the event there is a dispute arising from these Terms and Conditions (Dispute), a party may not commence court proceedings relating to any dispute without first meeting with the other party to (in good faith) resolve the Dispute. If the parties cannot resolve the Dispute at that meeting, either party may refer the matter to a mediator. The parties agree to attend the mediation in good faith. The costs of the mediation will be shared equally between the parties. Nothing in this clause will operate to prevent a party from seeking urgent injunctive or equitable relief from a court.

  1. LEGO® is a trademark of the LEGO Group of companies which does not sponsor, authorise or endorse the Promoter and Promotion.

 

Amendments

 

  1. The Promoter reserves the right to make changes to these Terms and Conditions at any time.   

 

  1. The Promoter may at its sole discretion amend any aspect of this Promotion or of these Terms and Conditions from time to time and without notice to you, subject to applicable laws and subject to the approval of the relevant authorities in each Relevant State, if required.

 

  1. Subject to Clause 38, the Promoter will publish the Terms and Conditions on the Website. It is the Entrants responsibility to regularly check the Website in case there are any changes made.

 

Entire Agreement

 

  1. These Terms and Conditions represent the entire agreement between the Promoter and any Entrant (including the winning Entrant) and supersede any prior agreement, understanding or arrangement between the Promoter and any Entrant (including the winning Entrants), whether oral or in writing.

 

Waiver

  1. Any failure by Brick News at any time to enforce these Terms and Conditions or any of its rights will not be a waiver of such rights, or affect the validity of these Terms and Conditions.

Force majeure

  1. The Promoter will not be liable for any loss, damage or expense caused by its failure to supply any product or perform any obligation under these Terms and Conditions as a result of any matter beyond the control of it.

​

Severability

  1. If any provision of these Terms and Conditions becomes void or unenforceable, it will be it will be severed from these Terms and Conditions without affecting the enforceability of the other provisions which will continue to have full force and effect.

​

Jurisdiction

  1. These Terms are governed by the laws of Queensland, Australia and each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Queensland, Australia.
